Louisiana 2025 HCR69
A CONCURRENT RESOLUTION
To create a task force to study and evaluate the merger of the Louisiana Motor Vehicle
Commission and the Louisiana Used Motor Vehicle Commission.
WHEREAS, Louisiana Motor Vehicle Commission and the Louisiana Used Motor
Vehicle Commission currently function as separate regulatory entities, each charged with
the licensure, regulation, and oversight of the motor vehicle industry in this state; and
WHEREAS, concerns have been expressed regarding the possible areas of overlap
in responsibilities, variations in enforcement practices, and opportunities to improve
efficiency through a review of the current structure of the two separate commissions; and
WHEREAS, in an effort to streamline Louisiana government, it is in the best interest
of this state to combine the two commissions; and
WHEREAS, combining resources and eliminating duplicate efforts will lead to cost
reductions including administrative expenses; and
WHEREAS, a unified commission can work more cohesively, leading to faster and
more consistent decision-making and implementation of policies, the elimination of
competing or inconsistent goals, rulemaking, and enforcement, and greater clarity to
regulatory requirements for licensees and the consuming public; and
WHEREAS, a merged commission can provide more convenient, consistent, and
comprehensive services to the public and eliminate confusion caused by having two very
similar entities; and
WHEREAS, consolidating the commissions allows for better budgeting and more
strategic allocation of resources which ensures that funds and personnel are directed where
they are most needed; and
WHEREAS, merging the commissions can foster a culture of collaboration and
innovation and eliminate cultures of division, differing visions, inconsistent rules, and
differing enforcement; and
WHEREAS, Governor Landry has committed to getting rid of waste and reducing
the amount of agencies in the state; and
WHEREAS, a thorough, data-informed evaluation of the commissions’ statutory
mandates, administrative operations, governance models, and regulatory practices, both in
Louisiana and in other states, is necessary to determine whether such a consolidation would
serve the public interest and improve industry oversight.
THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby
create a task force to study and evaluate the merger of the Louisiana Motor Vehicle
Commission and the Louisiana Used Motor Vehicle Commission.
BE IT FURTHER RESOLVED that the task force shall be composed of the
following members:
(1) The governor or his designee.
(2) Two members of the Senate Committee on Commerce, Consumer Protection and
International Affairs appointed by the president of the Senate.
(3) Two members of the House Committee on Commerce appointed by the speaker
of the House of Representatives.
(4) The attorney general or her designee.
(5) Two commissioners of the Louisiana Motor Vehicle Commission appointed by
the chair of the commission.
(6) Two commissioners of the Louisiana Used Motor Vehicle Commission appointed
by the chair of the commission.
(7) The president of the Louisiana Automobile Dealers Association or his designee.
(8) A licensed new car dealer engaged in the business of selling new cars appointed
by the governor.
(9) A licensed used car dealer engaged in the business of selling used cars appointed
by the governor.
BE IT FURTHER RESOLVED that the chair of the Louisiana Motor Vehicle
Commission and the Louisiana Used Motor Vehicle Commission shall serve as chairman of
the task force.
BE IT FURTHER RESOLVED that the task force shall review the feasibility of a
merger between the Louisiana Motor Vehicle Commission and the Louisiana Used Motor
Vehicle Commission which shall include but not be limited to the following components,
with particular attention to comparative practices and lessons learned from other states that
have undertaken similar evaluations or structural reforms:
(1) The composition, appointment process, qualifications, and governance structure
of each commission’s board, including how similar entities are structured in other states.
(2) The licensing, compliance, enforcement, and adjudication processes of each
commission, with an emphasis on identifying any overlap, inconsistencies, or inefficiencies,
and evaluation how such functions are integrated or streamlined in other jurisdictions.
(3) Internal administrative functions, including staffing models, training protocols,
and overnight mechanisms, with reference to successful administrative practices used in
comparable agencies elsewhere.
(4) Existing technological infrastructure and opportunities for modernization,
including the use of online applications, centralized complaint tracking systems, and digital
record keeping, and how other states have leveraged technology to improve regulatory
efficiency.
(5) Budgetary and financial operations, including funding sources, expenditures, and
the projected fiscal impact of consolidation or reorganization, informed by fiscal analyses
conducted in other states.
(6) The consistency and clarity of applicable rules, such as those governing
advertising, financing, and sales practices, including a review of how other states ensure
regulatory uniformity across related services.
(7) Best practices and models from other states that have consolidated or
restructured licensing and regulatory commission, including measurable outcomes,
implementation challenges, and stakeholder responses.
(8) The perspectives of key stakeholders, including new and used motor vehicle
dealers, consumer advocacy organizations, and relevant trade associations, as well as input
from counterparts in other states who have undergone similar transitions.
BE IT FURTHER RESOLVED that the task force shall study a possible timeline for
the merger.
BE IT FURTHER RESOLVED that the task force shall solicit input, advice, and
recommendations from the executive directors of each commission regarding the current
day-to-day operations of the commissions.
BE IT FURTHER RESOLVED that the task force is authorized to request
information, reports, documents, and assistance from any state agency or political
subdivision, including the Louisiana Motor Vehicle Commission and the Louisiana Used
Motor Vehicle Commission, as may be necessary to carry out its duties.
BE IT FURTHER RESOLVED that members shall serve without compensation
except for per diem or expenses to which they may be entitled as members of their
organizations.
BE IT FURTHER RESOLVED that a majority of the total membership shall
constitute a quorum of the task force, and any official action taken by the task force shall
require an affirmative vote of the majority of the quorum present and voting.
BE IT FURTHER RESOLVED that the initial meeting of the task force shall take
place no later than August 1, 2025.
BE IT FURTHER RESOLVED that the Louisiana Motor Vehicle Commission shall
provide staff support to the task force.
BE IT FURTHER RESOLVED that the task force shall issue a report of its findings
and recommendations to the Legislature no later than December 31, 2025.
BE IT FURTHER RESOLVED that the task force shall submit one print copy and
one electronic copy of any report produced pursuant to this Resolution to the David R.
Poynter Legislative Research Library as required by R.S. 24:772 and to the House
Committee on Commerce and the Senate Committee on Commerce, Consumer Protection
and International Affairs.
