Baton Rouge, LA – The Louisiana Used Motor Vehicle Commission (LUMVC) held an Administrative Hearing on January 24, 2011, JAMES MARCH, OWNER, MID CITY AUTO, INC. formerly located at 2121 Williams Boulevard, Kenner, Louisiana and now located at 4101 Airline Drive, Metairie, Louisiana, was assessed a fine for eleven (11) counts of La. R. S. 32:792(B)(2) – Committing a fraudulent act. IT WAS HEREBY FURTHER ORDERED, ADJUDGED AND DECREED that the Mid City Auto, Inc. shall revise its Buyer’s Order Form to clearly state, “Deposit is only refundable if financing cannot be arranged” and to require the customer to acknowledge this term. The Used Motor Vehicle Dealer License issued to James March for the operation of Mid City Auto, Inc. and the Salesman License issued to James March is hereby placed on PROBATION for one (1) year.

R. S. 32:792(B)(8) Engaging in a practice of failing to delivery certificates of title to a consumer. Two-thousand dollars and no/100 ($2,000.00) each for two (2) counts in violation of La. R. S. 32:792(B)(2) Committing a fraudulent act. Two thousand dollars and no/100 ($2,000.00) each for two (2) counts in violation of La. R. S. 32:792(B)(10) Engaging in the practice of failing to remit sales tax. Two hundred dollars and no/100 ($200.00) each for one (1) count in violation of La. R. S. 32:792(B)(12) Engaging in the practice of issuing temporary license plates or temporary dealer’s plates in violation of the law. Two thousand dollars and no/100 ($2,000.00) each for one (1) count in violation of La. R. S. 32:791(A)(1) Engaging in business as, or serve in the capacity of, or act as a used motor vehicle dealer, rental dealer, or used motor vehicle salesperson without first obtaining a license and Six hundred and no/100 ($600.00) for all cost of the investigation and the administrative hearing. IT WAS HEREBY FURTHER ORDERED, ADJUDGED AND DECREED that no license shall be issued to ASAP AUTO SALES, INC. or DOROTHY ANDRY without a hearing before the Commission.

Baton Rouge, LA – The Louisiana Used Motor Vehicle Commission (LUMVC) held an Administrative Hearing on March 21, 2011, on MOHAMMAD IBRAHIM, INDIVIDUALLY AND VALUE IMPORT, INC. located at 8250 Florida Blvd., Baton Rouge, Louisiana 70806. This dealership was assessed fines for the following violations: Two Hundred Dollars and no/100 ($200.00) each for three (3) counts in violation of La. R. S. 32:792(B)(2) Committing a fraudulent act in selling, purchasing, or dealing in used motor vehicles or misrepresenting the terms and conditions of a sale, purchase, or contract for sale or purchase of a used motor vehicle or any interest including an option to purchase. Two Hundred Dollars and n0/100 ($200.00) each for two (2) counts in violation of La. R.S. 32:792(B)(5) Employing an unlicensed salesperson or other unlicensed person in connection with the sale of a used motor vehicle. Five Hundred Dollars and no/100 ($500.00) each on twenty (20) counts in violation of La. R.S. 32:792 (B)(8) Engaging in a practice of failing to deliver certificates of title to a consumer within the time limitations prescribed in R.S. 32:705. One Hundred Dollars and no/100 ($100.00) each on one (1) count in violation of La. R.S. 32:792(B)(9) Engaging in a practice of failing to submit monthly sales reports to Motor Vehicle Audit by the twentieth day of the following month. Two Hundred Dollars no/100 ($200.00) each on sixteen (16) counts in violation of La. R.S. 32:792(B)(11) Engaging in a practice of leaving the certificate of title open or unassigned to the dealer. Two Hundred Dollars and no/100 ($200.00) each on one hundred (100) counts in violation of La. R.S. 32:792(B)(12) Engaging in a practice of issuing temporary license plates or temporary dealer’s plates in violation of the law. Two Thousand Dollars and n0/100 ($2,000.00) each on two (2) counts in violation of La. R.S. 32:792(B)(14) repossessing a vehicle in a manner other than what is allowed by law, and Six Hundred Dollars and no/100 ($600.00) for costs of the investigation and administrative hearing. The Used Motor Vehicle Dealer License issued to MOHAMMAD IBRAHIM for the operation of VALUE IMPORT, INC. is hereby REVOKED.

Baton Rouge, LA – The Louisiana Used Motor Vehicle Commission (LUMVC) held an Administrative Hearing on December 19, 2011, on King of Kars, Inc. d/b/a King of Kars located at 2961 East Texas Street, Bossier City, Louisiana 71111. They were assessed fines for the following violations: Five Hundred Dollars and no/100 ($500.00) each for two (2) counts in violation of La. R.S.32:792(B)(2) Committing fraudulent acts in selling or dealing in used motor vehicles by misrepresenting the terms of the sales, purchases, or contracts for sale or purchase of a used motor vehicle by knowingly filing false affidavits. Five Hundred Dollars and no/100 ($500.00) each for twelve (12) counts in violation of La. R.S. 32:792(B)(8) Failing to delivery certificates of titles to vehicles to consumers within the time limitations prescribed in R.S. 32:705; Five Hundred Dollars and no/100 ($500.00) each for seven (7) counts in violation of La. R.S. 32:792(B)(12) Issuing temporary license plates or temporary dealer’s plates in violation of the law and; One Hundred Dollars and no/100 ($100.00) each for one (1) count in violation of La. R.S. 32:792 (B)(11) Leaving the certificate of title open or unassigned to the dealer and Six Hundred Dollars and no/100 ($600.00); and that Nine Thousand Two Hundred Dollars and no/100 ($9,200.00) of the fines imposed are hereby suspended provided that JOEY GULLO and KING OF KAR, LLC D/B/A KING OF KARS comply with the following conditions: Pay the fine of One Thousand Four Hundred Dollars and no/100 ($1,400.00) and costs of Six Hundred Dollars and no/100 ($600.00) on or before March 19, 2012; Representative from dealership attend the entirety of an educational seminar conducted by the Commission on or before February 20, 2012; and JOEY GULLO and KING OF KARS, LLC D/B/A KING OF KARS comply with all laws and rules applicable to the sale of used motor vehicles for a period of one year.

 

JUDGEMENT: $11,200.00 FINE (including administrative hearing fee)
